Delaware has not enacted its own state law governing debt collection tactics, but enforces the Federal Fair Debt Collection Practices Act. Its residents are thus protected under the federal law. Delaware law does require collectors within the state to pay a fee and obtain a license, but it does not appear that consumers can bring an individual lawsuit if a collector fails to do so. Thus, Delaware residents faced with abusive or harassing collection tactics will receive the most protection and benefit from the FDCPA.
